General Terms and Conditions

1. The scope of the General Terms and Conditions

1.1. These General Terms and Conditions (hereinafter: GTC) include the rules of the contractual relationship between ANGOL INTÉZET Nyelvi Szolgáltató Korlátolt Felelősségű Társaság, having its registered seat at 1051 Budapest, Széchenyi István tér 7/8, Bldg. C, 1st floor (hereinafter:  Language School) and the language learner in a contractual relationship with it (hereinafter: Student), governing the provision of language teaching services. The language teaching contract consists of an individual contract (application form) and the present GTC. The individual contract is supplemented by the provisions of the course notification letter sent to the Student in accordance with Section 4 hereof.

1.2. The precondition of the use of the language teaching service is the acceptance of the GTC by the Student. By completing and submitting the application form, the Student accepts the GTC and acknowledges that his/her personal data are entered in the database of the Language School.

 2. Group courses offered by the Language School for private customers, the content of the courses

2.1.1. Communication Doping business English course – high-quality, communication-focused business English course.

2.1.2. Online Communication Doping business English course – high-quality, communication-focused business English course, in online format.

2.1.3. IELTS preparation course – high-quality language course in preparation for the internationally recognized and widely accepted IELTS (International English Language Testing System) language examination.

2.1.4. Online IELTS preparation course – high-quality language course in preparation for the internationally recognized and widely accepted IELTS (International English Language Testing System) language examination, in online format.

2.2. Language School – the language school organizing the language courses is Angol Intézet. The Language School undertakes an obligation to organize high-quality business English and IELTS preparation courses at the times and venues (in case of in-person courses), as well as with the teachers and conditions advertised on its website.

2.3. Teacher – university/college graduates, with internationally recognized certifications and several years of teaching experience, who are native speakers or native-level speakers of English.

2.4. Student – persons who complete all four steps of the application process in time.

2.5. Credits – a certain amount of course fee from a previous course which can be transferred to be used in a later course. There are two types:

  • credits from missed lessons (see the detailed conditions of availability and use in Section 10.4 below);
  • credits from unfinished course (see the detailed conditions of availability and use in Section 10.5 below).

2.6. Certificate – certificate issued by the Language School at the request of the Student, evidencing the successful completion of the adult education course.

3. Application process (registration)

3.1. The application process consists of the following five steps:

  • completing the application form according to the given type of the course;
  • providing the data to be processed by the Language School pursuant to Section 75 and 76 (“Data processing by adult education institutions”) of Act CXLVIII of 2020 by the starting date of the course (the personal identification data of the natural person participating in the course, e-mail address and highest level of education completed). The Language School shall process these data until the last day of the eighth year after the conclusion of the adult education contract.
  • the completion of the online placement test (not necessary in case of returning Students; however, if the Student completed his/her last course at the Language School more than a year before, the Language School may require the Student to complete the placement test again, in order to determine the Student’s current level of proficiency);
  • participation in a verbal assessment of the Student’s level of proficiency, which can be conducted, subject to the Student’s choice, either via telephone or at the venue at Széchenyi István tér 7/8 (the verbal assessment is not necessary in case of returning Students; however, if the Student completed his/her last course at the Language School more than a year before, the Language School may require the Student to participate in the verbal assessment again, in order to determine the Student’s current level of proficiency);
  • the payment of the course fee (or the first instalment of the course fee) by the payment deadline indicated on the website; the course fee may be paid, subject to the Student’s choice indicated on the application form, either in a lump sum or (in case of 12 and 11-week courses) in two equal instalments due in the first and second months of the course, by way of bank transfer.

In case the course fee is paid by a company/employer, in addition to the completion of the first three steps of the application process, it is the responsibility of the Student to ensure that the given company/employer pay the course fee by the relevant payment deadline.

In case of a lump-sum payment by bank transfer, the full amount of the course fee, while in case of payment in instalments, the first instalment shall be paid in the amount and by the payment deadline indicated on the website.

If the payment deadline is not separately indicated on the website, payment is

due at the time of the deadline for applying to the course.

In case of courses shorter than 11 weeks, the course fee is due in a lump sum, by way of bank transfer.

3.2. The application process is considered as completed and the individual language teaching contract as concluded if the Student has performed the steps specified in Section 3.1 in full by the payment deadline.

3.3. The individual language teaching contract between the Language School and the Student shall qualify as a contract concluded by electronic means, as defined and regulated by Section 6:82 of the Civil Code, and also as an adult education contract concluded in accordance with Act LXXVII of 2013. The language of the contract shall be English. Before the contract is concluded, the Language School shall provide an opportunity on the online interface used for registering for the courses to identify and correct any errors occurring during the electronic recording of the data. The Language School shall record the contracts electronically, and shall store them in its database for eight years.

 4. Notification of the start of the course (course notification letter)

After the application deadline indicated on the website, but before the starting date of the course, the Language School shall send a course notification letter to the Student by e-mail, in which the Student is informed about the organization of the group, the starting of the course, and detailed information is also provided on the group, and on the payment deadlines in case of payment in instalments.

5. The formation and changing of groups

5.1. The size of the groups – The Language School undertakes to organize the courses with the group sizes indicated on the website.

5.2 If, in the absence of reaching the minimum number of students for a group, as indicated on the website, the group cannot be started on the Student’s level of proficiency at the venues selected by the Student (in case of in-person courses), the Language School shall offer an alternative option or options for the Student in accordance with Section 5.3.

5.3. If the Student does not accept the alternative option(s) offered, the Language School agrees to refund the course fee already paid by the Student, by way of bank transfer to the bank account identified by the Student, within 5 to 15 business days.

5.4. If, after the start of the course, the size of the group decreases under the minimum number of students specified for the type of course offered, the Language School reserves the right to combine the group with another group, while also taking into consideration the upper limit of the group size, or to recommend another group for the Student.

If the Student does not accept this change, at the option of the Student, the time-proportionate part of the course fee shall be refunded, or it can be used in the form of credits within a year for later course organized by the Language School. The Language School shall refund the time-proportionate part of the course fees to the bank account identified by the Student within 5 to 15 business days.

5.5. If the Student fails to pay the course fee as due by the relevant deadline, the Language School reserves the right to notify the Teacher of this fact, to cancel the Student’s right to attend the lessons, to terminate the language teaching contract, and to assign the place of the Student to another Student.

5.6. The Student may terminate the language teaching contract unilaterally, if the Language School does not teach the course for any reason arising on the part of the Language School, and fails to offer the Student an opportunity to attend another course instead.

6. The venues for in-persons courses:

6.1. The Language School teaches its courses at the following venues:

  • Roosevelt 7/8. Irodaház (Pest) Széchenyi István tér 7-8. (at the Chain Bridge),
  • Károly körút Office Building (Pest), Károly körút 3/A. (at the Astoria),
  • Duna Tower (Pest), Népfürdő u. 22. (at Göncz Árpád Városközpont),
  • Hattyú House (Buda), Hattyú u. 14. (at Mikszáth Kálmán tér).

6.2. All course venues specified in Section 6.1 above are high-quality, air-conditioned, category A or A+ offices, with meeting rooms.

6.3. In case of in-person courses, with a view to any possible official restrictions enforced due to the COVID-19 pandemic situation, the current measures applied by the Language School are available at the following link:

6.4. With a view to the pandemic situation that may emerge during the course, in the interest of protecting the health of the Teachers and Students, the Language School may, and in case of lockdown measures ordered by the health authorities, it is required to switch to online teaching. The Student shall not be entitled to any compensation, and may not request a refund after the payment period, with reference to the introduction of online teaching, and the Language School is not entitled to charge any additional fees for organizing and teaching the Course online.

6.5. In case online teaching is introduced, the lessons shall be held at the times identified in the course information notification sent to the Students electronically, using the online platform chosen by the Language School.

The Student shall to arrange for the technical conditions of online teaching (laptop/desktop computer, web camera, headphones with built-in or external microphone), as well as for internet connection of sufficient speed. All other information necessary for participation in online teaching shall be sent by the Language School to the Students in due time.

7. The platform used for the online courses, technical conditions

7.1. The Language School primarily uses the Zoom application for online teaching.

In case of technical problems in connection with the use of the Zoom application, the Language School reserves the right to use other applications suitable for videoconferencing.

In order to join the online lessons, prior to the first lesson identified in the course notification letter, the Student is required to set up a free Zoom account, using his or her own name, and to log in to the online lessons using that account.

7.2. The Student shall arrange for the technical conditions of online teaching (laptop/desktop computer satisfying the minimum system requirements for starting the Zoom application, web camera, if possible, headphones with built-in or external microphone), as well as for internet connection of sufficient speed.

7.3. During the lessons, the Student is required to keep the web camera and the microphone turned on, so that the continuous communication with the group and the Teacher can be ensured. If the Student obstructs the lesson by continuously turning the microphone and/or web camera on and off, which means that the Student is not participating in the lesson, the Teacher will warn the Student verbally. If, after the verbal warning, the Student still does not keep the microphone and/or web camera on, thereby not participating in the lesson, the Teacher may exclude the Student from the lesson.

7.4. The technical information necessary for participation in online teaching shall be sent by the Language School to the Students in due time.

7.5. All groups will be assigned a unique identifier called a “meeting ID” for connecting to the online lessons through the Zoom application, which the Language School shall send to the Student via e-mail by the first day of the course. Disclosing the unique identifier and the password to any third party is strictly prohibited, and may lead to the exclusion of the Student from the course. The identifier may change during the Course for technical reasons; the Language School shall inform Students of such changes in due time.

7.6. For internal quality assurance purposes, the Language School may record certain online lessons, and may store or use such recordings, strictly for the purpose of the recording and in compliance with the relevant rules of data protection.

8. Course materials

8.1. There is no need to purchase any textbooks or course materials for participation in the courses organized by the Language School. The Language School shall provide all course materials necessary for its own language teaching program. Further information on the curriculum of the course is available on the website of the Language School, on the page of the given course type.

9. Duration of the course

9.1. The Communication Doping business English courses organized by the Language School consist of 48 or 24 lessons of 45 minutes in length, as indicated on the website. The IELTS preparation courses consist of 44 or 22 lessons of 45 minutes in length. If a lesson is cancelled due to school holiday, a bank holiday or a workday rescheduled for a Saturday, the make-up class will be held on the day indicated on the website before the first day of the course.

10. The course fee

10.1. The current fee schedule of the Language School is published on the website of the Language School, on the page of the given course type, under the detailed information.

10.2. The Language School reserves the right to change the fees indicated on the website. Any changes of the course fees shall be made by the Language School by amending the present GTC and publishing it on the website. The new fees shall be effective on the date of the amendment of the GTC. The individual language teaching contract is always concluded in accordance with the fee schedule in effect on the date of the completion of the application form.

10.3. Course fee instalment – The part of the course fee, as specified on the website, which is to be paid by the Student by way of bank transfer for half of the course in case the Student chose to pay the course fee in instalments. The Student shall pay the instalments of the fee for the course selected at the time of application by the payment deadlines indicated.

10.4. Credit for missed lessons – The Language School is not in a position to organize/make-up for the missed lesson(s) at another time if, for any reason, the Student is unable to attend one or several lessons. Instead, the Student may request from his/her Teacher to send the material of the given lesson by e-mail.

In addition, if the Student signs up for a next Communication Doping business English course or an IELTS preparation course, then the Language School will apply the time-proportionate amount for the lost lessons as credit toward the fee of that subsequent course up to the following limits:

  • if choosing a course consisting of 48 or 44 lessons: maximum 8×45 minutes;
  • if choosing a course consisting of 24 or 22 lessons: maximum 4×45 minutes.

The basis for the calculation of the time-proportionate credit in all cases is the lump-sum amount of the course fee payable for the full length of the course, as indicated on the website of the Language School (regardless of the payment method – payment in a lump sum or in instalments – the Student chose in case of the Course completed earlier).

When determining the amount of the credit, the Language School will take into consideration the online attendance register kept by the Teacher. On the application form completed at the time of registration, the Student shall indicate how many lessons he/she missed, and the Language School shall check this against the online attendance register kept by the Teacher. In case of any difference between the information provided by the Student and the content of the attendance register, the online attendance register shall be guiding.

10.5. Credits in case of not finishing an earlier course – If the Student notifies the Language School after the money-back period for the given group as specified in Section 14.1, by writing to the tanfolyam@angolintezet.hu e-mail address that, for any reason, he/she is unable or does not wish to complete the course, the Language School shall issue a time-proportionate amount of credits to the Student. These credits may be used, within one year from the time it is issued, towards the fee for a later Communication Doping business English course or an IELTS preparation course organized by the Language School, or it may be assigned by the Student to a third party. The credits may not be redeemed for cash, and no refunding is possible even during the 100% money-back guarantee period of a later Language Course either.

The basis for the calculation of the time-proportionate credit shall be the proportion between the number of lessons still left from the course at the time when the Student notifies his/her intention to not finish the course by writing to the tanfolyam@angolintezet.hu e-mail address to the total number of lessons of the course. When calculating the amount of the credits, it cannot be taken into consideration how many lessons the Student actually participated in and since when he/she has not attended the lessons.

The credits from an unfinished course and the credits from missed lessons, as specified in Section 10.4 cannot be combined when applying to the course after the unfinished course.

If a course for which the Student paid the fee in instalments was not finished, all instalments still unpaid must be paid in full.

The financial handling of credits in case of an unfinished course: If the Student wishes to use credits from an earlier, unfinished course for payment for another course, this is to be indicated on the application form in the “Eligibility to discounts” field, with detailed reasons and the and the extent of the discount intended to be used also entered.

In case of paying the full fee of an unfinished course as a lump sum, the basis for the calculation of the time-proportionate amount is the full course fee.

In case of paying the fee for an unfinished course in instalments, the credits for a later course may only be used if all instalments of the unfinished course have been paid. In this case, the basis for the calculation of the time-proportionate amount is the sum of the instalments thus paid.

11. Changing groups

11.1. If, for any reason, the Student wishes to change groups, provided that there is another group at a similar level of proficiency at another time which – also with attention to the maximum size of the group indicated on the website – has free capacities, then the Language School shall provide an opportunity for the Student to try that group until

  • the end of the first 180 minutes of the course in case of 24-lesson courses meeting for 1 or 2 sessions a week,
  • the first 2 sessions of the course in case of 24-lesson courses meeting for 3 sessions a week, and
  • the end of the first 360 minutes of the course in case of 48 and 44-lesson courses.

11.2. If the group Student prefers the other group tried, the Student may continue the course in that new group, subject to the positive professional opinion of the Teacher assigned to the group and the Language School.

11.3. In case of joining a group later, changing the group is possible in accordance with the rules written under Section 11.1; however, the deadlines apply from the date when the Student first received the opportunity from the Language School to participate in the course.

12. The substitution of Teachers

12.1. If, due to vacations or other unexpected circumstances, the Teacher assigned to the given group cannot continue to teach the group, the Language School shall primarily attempt to provide a substitute Teacher at the original time slots.

12.2. In case it is impossible to organize the substitution in accordance with the above, the Teacher assigned to the group, or the substitute Teacher appointed by the Language School, the Language School shall arrange times for make-up lessons with the teacher or substitute teacher. The Language School shall notify the students in advance of the make-up class times.

13. Payment terms

13.1. Payment methods – the fees for the courses organized by the Language School may be paid in two ways:

  • in a lump sum (pre-payment), by way of bank transfer;
  • in two equal instalments (pre-payment), by way of bank transfer.

In case of courses shorter than 11 weeks, the course fee is due in a lump sum, by way of bank transfer.

Both in case of lump-sum payment and payment in instalments, if upon the completion of the course paid for the Student wishes to start another course, he/she must apply separately and again by the application deadline indicated on the website. If the payment deadline is not indicated on the website, then the payment deadline is the same as the application deadline.

13.2. Conditions applicable to lump-sum payments

  • In case of lump-sum payment, the full amount of the course fee is to be paid by way of bank transfer by the payment deadline indicated on the website. If the payment deadline is not indicated on the website, then payment deadline is the same as the application deadline.
  • The financial handling of credits in case of a missed lessons: In case of lump-sum payment, the electronic payment request is issued automatically for the course fee reduced by the credit for missed lessons indicated by the Student (see Section 10.4 on the use of credits). In the online attendance register kept by the Teacher, the Language School shall check the number of lessons indicated by the Student as missed, and in case of any difference, the originally issued payment request/invoice shall be cancelled, and a new payment request/invoice shall be issued on the basis of the online attendance register kept by the Teacher.

13.3. Conditions applicable to payments in two instalments:

  • Payment in instalments is only available in case of courses lasting 11 or 12 weeks.
  • In case of payment in instalments, the first instalment is to be paid by the payment deadline indicated on the website. If the payment deadline is not indicated on the website, then the payment deadline is the same as the application deadline. The payment deadline for the second instalment of the course fee shall be notified by the Language School in the course notification letter sent to the Student.
  • In case of payment in instalments, the Student shall pay both instalments to the Language School, regardless of whether or not the Student actually participates at the lessons.
  • The financial handling of credits in case of an missed lessons: In case of payment in instalments, if the Student wishes to use credits for missed lessons from an earlier course, the Student must indicate on the application form for the new course how many lessons he/she missed (see Section 10.4 on the use of credits). The Language School shall check the above on the online attendance register. In case of any difference between the information provided by the Student and the content of the attendance register, the online attendance register shall be guiding. The discount on the basis of credit for missed lessons, checked and confirmed on the basis of the attendance register, shall be deducted by the Language School from the second instalment of the course fee.

14. Money-back guarantee

14.1. If, for any reason, the Student decides

  • until the end of the first 360 minutes of the course in case 24 22-lesson courses,
  • until the end of the first 180 minutes of the course in case 24 22-lesson courses meeting for 1 or 2 sessions a week,
  • until the end of the second session in case 24 or 22-lesson courses meeting for 3 sessions a week,

that he/she does not wish to continue the course, and notifies this decision to the Language School by writing to the tanfolyam@angolintezet.hu e-mail address, also indicating his/her bank account number in such notification, then the Language School shall refund the full amount of the course fee paid until that time, by way of bank transfer to the bank account identified by the student, within 15 business days. In case of the refunding of the course fee in accordance with the above, the Language School may not have any further claims for fees against the Student.

The exact deadline (day and hour) for using the money-back guarantee shall be indicated by the Language School for each course in advance, and included in the course notification letter.

14.2. The period of the money-back guarantee shall start on the first lesson of the course, as indicated on the website, and in case of a Student joining the course later, on the first lesson where the Student was given an opportunity by the Language School to participate in the given course.

In case of changing groups, the period of money-back guarantee shall start from the first lesson where the Student was given an opportunity by the Language School to participate in the given course. In such a case, the Language School shall determine the exact deadline for the money-back guarantee in the information letter sent to the Student on the changing of the group.

The period of the money-back guarantee shall not be extended in any case by the duration of lessons in which the Student does not participate for reasons arising in his or her own sphere of interest.

15. The handling of complaints

15.1. Students may submit any complaints related to the language teaching by way of electronic mail sent to the tanfolyam@angolintezet.hu e-mail address. The same channel may also be used for submitting any positive comments. The Language School shall examine all complaints submitted, and shall exercise utmost care to remedy any legitimate complaints to the satisfaction of the Student.

16. The cases, legal basis and purpose of data processing related to teaching, the scope of the personal data processed and the duration of processing

16.1. The data processed in the interest of concluding the contract and performing the service: In the interest of concluding the contract and performing the service, the processing of personal data may be necessary in several stages of the process. If a visitor of the website does not eventually apply for a course, then the rules of data processing for marketing purposes may apply, provided that the visitor has given consent to data processing for marketing purposes. Contact

Anyone may contact the Language School in connection with a course by e-mail, using the contact form of the website or over the telephone. Preliminary contact is not necessary, as anyone may also apply to courses advertised directly, without making preliminary contact.

Scope of processed data

The personal data provided by data subjects in the course of making contact.

The duration of the data processing

The data may only be processed until the end of the contact.

The legal basis of the data processing

The voluntary consent of the data subject, which is given to the Language School as controller by way of making contact. [Article 6 (1), point a) of the GDPR]

 

Registration on the website

By storing the data provided during the registration, the Control can offer a more convenient service, as the data subject does not need to enter his/her data again when applying again.

Scope of processed data

The Controller processes the name, invoicing address, telephone number, e-mail address of the data subject, as well as the date of contact.

The duration of the data processing

Until the revocation of the consent.

The legal basis of the data processing

The voluntary consent of the data subject, which is given to the Controller by way of the registration. [Article 6 (1), point a) of the GDPR]

 

Performance of the contract

Data processing activities necessary on the basis of applying for a course, in the interest of the performance of the language teaching contract.

Scope of processed data

The Controller processes the name, place and date of birth, the invoicing address, telephone number and e-mail address of the data subject.

The duration of the data processing

The data may be processed for 5 years according to the period of limitation under civil law.

The legal basis of the data processing

Performance of the contract [Article 6 (1), point b) of the GDPR]

 

Invoicing

The data processing takes place in the interest issuing an invoice in compliance with the relevant laws and the performance of the obligation to retain the accounting documents. Pursuant to Section 169 (1)-(2) of the Accounting Act, economic entities shall retain the accounting documents underlying their accounting records directly or indirectly.

Scope of processed data

Name, address, e-mail address, telephone number.

The duration of the data processing

Pursuant to Section 169 (2) of the Accounting Act, invoices shall be retained for 8 years after their data of issuance.

The legal basis of the data processing

Pursuant to Section 159 (1) of Act CXXVII of 2007 on Value Added Tax, it is mandatory to issue an invoice, and pursuant to Section 169 (2) of Act C of 2000, the invoice shall be retained for 8 years. [Article 6 (1), point c) of the GDPR]

 

The handling of consumer complaints

The processing of data takes place in the interest of handling consumer complaints. If the Student submitted a complaint to the Language School, the provision and processing of data is necessary.

Scope of processed data

Name, telephone number, e-mail address, content of complaint.

The duration of the data processing

Pursuant to the Act on Consumer Protection, complaints shall be retained for 5 years.

The legal basis of the data processing

Pursuant to Section 17/A (7) of Act CLV of 1997 on Consumer Protection, the documentation of complaints shall be retained for 5 years. [Article 6 (1), point c) of the GDPR]

 

16.2. Data processing for marketing purposes

Data processing related to the sending of newsletters:

Remarketing:

Data processing as a remarketing activity takes place with the help of cookies.

Scope of processed data

The data processed by way of the cookies, as specified in the notice on cookies.

The duration of the data processing

The duration of data storage by way of the given cookie.

The legal basis of the data processing

The voluntary consent of the data subject, which is given to the Controller by way of using the website. [Article 6 (1), point a) of the GDPR].

 

16.3. The data processed in connection with the proof of the consent

In the course of registration, applying for a course or signing up for a newsletter, the IT system stores the information related to the consent in the interest of subsequent retrievability as proof of consent.

Scope of processed data

The date and time of the consent, as well as the IP address of the data subject.

The duration of the data processing

For compliance with the relevant provisions of law, it is necessary to have proof of the consent; therefore, the data are stored until the end of the limitation period after the end of the data processing.

The legal basis of the data processing

This data processing is prescribed as a legal obligation by Article 7 (1) of the GDPR. [Article 6 (1), point c) of the GDPR]

 

16.4. Additional cases of data processing

In case the Controller wishes to engage in any additional data processing, it shall provide prior information on all the essential circumstances of the data processing (the statutory background and legal basis, as well as the purpose of the processing, the scope of the data processed, the duration of the processing). The Controller is required to comply with written requests of the authorities for the disclosure of data, based on statutory authority. The Controller shall maintain records of any transmissions of personal data in accordance with Section 15 (2)-(3) of Act CXII of 2011 on the Right of Informational Self-Determination and on Freedom of Information (what personal data was transmitted by the Controller when, to what authority, and with what legal basis), and the Controller shall provide information on the above upon request, except when the provision of such information is excluded by law.

16.5. The Student shall inform the Language School of any changes in his/her personal data (e-mail, telephone number, address) provided for the Language School as controller. Any legal consequences arising as a result of failure to provide such information shall be borne by the Student.

17. The use and the activities of data processors

17.1. Data processing related to payments, accounting and invoicing: Számlázz.hu, RTH Consulting Bt., KRISZBRIG Kft., Meyer & Levinson Kft.

On the basis of written contracts concluded with the Language School, the Processors participate in the management of accounting documents. In the course of the above, the Processors process the name and address of the data subjects to the extent necessary for the purposes of the accounting records, for the duration prescribed by Section 169 (2) of the Accounting Act, and erasing them without delay afterwards.

17.2. Data processing related to online classes: Zoom Video Communications, Inc.

The Processor shall provide the online interface for connection in case of the courses of the Language School taught in online form, in the course of which the Student shall joint the lessons using their own applications and user names selected by themselves.
